Dealing with Litigations

This policy sets out the Skylink network criteria design for global code of ethics.

Effective: 20 January 2020

Overview

This policy sets out the Skylink Network’s Dealing Criteria with Litigations.

Skylink Network understands that most of the shippers are the least knowledgeable of claims for cargo loss and any damage and any misplacement. Knowledge of the basic legal distinctions and the applicable laws and regulations is critical in dealing with cargo claims.

Scope

This policy applies to everyone who works for Skylink network in any capacity, full-time, part-time, or casual, including temporary employees and contractors.

Principles

Skylink Network understands that cargo claims are based upon a breach of contract by the carrier, not whether the carrier was negligent. We set a lawful principle to avoid any claims using the following guidelines:

  • Damage of cargo: Packaging is the most common way to avoid and minimize the shipment damage. Before proceeding the shipment, we recommend our operational teams and shippers to palletize the cargo; ensure the packaging is suitable for the cargo it contains; and mark instructions and labeling.
  • Documents verification: When we receive a shipment, our employees thoroughly examine the delivery and paperwork; verify the delivery receipt, which is a legally-binding document; verify the delivery address and shipment information; count the items on the delivery receipt and compare to the quantity being delivered; and inspect the condition of the shipment to avoid any claim.
  • Verification of Special Cargo: Skylink Network’s specialized team verifies all the documents, packaging, and stowage plan before loading the cargo in carrier to avoid any incompatibility with other cargo and incident claims.

Skylink Network Insurance Policy

Skylink Network has the strong and secure insurance policy regarding claims and litigations. Before processing shipments, we assist our clients using appropriate mode. We manage all the operations securely till the shipment arrive to its destination and if there seem any irregularities in the documentations, labeling, marking, and packaging, we immediately inform to the shipper and ensure 100% re-working. The insurance policy provides financial protection and covers all aspects of risks of physical damage or loss to goods during transportation from external sources.
